The Kaduna State Bureau Chief of the Vanguard Newspaper, Mr. Luka Binniyat, on Tuesday regained freedom after meeting his bail condition. Led by his lawyer, Barrister Samson Bemu from James Kanyip Partners chambers, Binniyat walked into freedom after spending a night at the Kaduna Prisons.
Binniyat was on Monday charged before a Kaduna Chief Magistrate Court 1 for allegedly fabricating injurious and falsehood publication capable of causing disturbance of public peace contrary to section 393 and 113 of the State Penal Code.
According to the charge sheet, the Vanguard Bureau Chief is alleged to be behind “a circulatory publication on newspapers and social media containing a falsehood statements capable of breaching the public peace.
“Whereby you stated that five (5) students of College of Education, Gidan Waya, Kafanchan, were ambushed and shot dead by herdsmen somewhere close to Gidan Waya, amongst other injurious statements, which you know and believed very well that it was not true. An intrigue to cause feud among the peoples living within Kaduna State, thereby committed an offense punishable under section 393 and 113 of the penal code law of Kaduna State 1991.”
The Chief Magistrate, Emmanuel Yusuf, had granted Binniyat bail to the tune of N200,000 and a surety in like sum. The surety must reside within the jurisdiction of the court, covered with a Certificate of Occupancy.
The bail condition for the release of the journalist is expected to be completed on Tuesday morning.
Members of the Kaduna State Council of the Nigeria Union of Journalists, led by its Chairman, Adamu Yusuf, were at the court premises in their hundreds to show solidarity with Binniyat.
Luka Binniyat, it was gathered, has been outstanding in the reportage of the killings in Southern Kaduna. Catholic cathedral Kafanchan has said in a document that over 800 people have been killed in some local governments in Southern Kaduna.
But the National Emergency Management Agency (NEMA), said about 204 people were killed in Jama’a and Chikun LGAs.
Elanza News reports that the Vanguard correspondent was the one who broke the News that Kaduna state governor, Mr el-Rufai has asked people who were not happy with his style of governance to go and climb Kufena mountain. Binniyat also reported how Mr el-Rufai ‘paid foreign herdsmen to stop the killings in Southern Kaduna.’
